Public procurement
Representation before the Antimonopoly Committee of Ukraine as the procurement review body: complaints about discriminatory tender conditions and unlawful decisions of contracting authorities, defence of winners against complaints by competitors.
Why PROCTOR
Taking part in public procurement calls for impeccable observance of the procedures, because even a formal mistake may cost a company a contract worth millions.
PROCTOR supports procurement participants at every stage of the procedure - from analysis of the tender documentation to challenging decisions of contracting authorities and defending the interests of clients before the Antimonopoly Committee of Ukraine and in the courts.
We help business exercise its rights in public procurement effectively and minimise the risk of losing contracts.
Interaction with state authorities (GR)
How a procurement challenge runs
From a reading of the tender documentation to a decision of the review body and its execution by the contracting authority.
01
Analysis of the tender documentation
We read the requirements of the contracting authority and look for discriminatory conditions tailored to a particular bidder. We record the deadlines within which a complaint is still possible.
02
Grounds and strategy
We decide what will work: a complaint about the conditions of the procurement, about a decision to reject a bid, or a defence of our own win against a complaint by a competitor.
03
Filing the complaint
We prepare the complaint to the review body with the evidence and the calculations and file it through the electronic system. The procurement is suspended for the duration of the review.
04
Hearing before the panel
We present the position of the company at the hearing of the panel of the Antimonopoly Committee, answer the arguments of the contracting authority and the other side and work for a specific decision.
05
Execution of the decision
We watch that the contracting authority carries out the decision of the review body, and if the procedure is breached further we take the dispute to court.
Formats of support in procurement
We choose by whether a single complaint is needed or support for the company across every procedure of the season.
Audit of tender documentation
We check the procurement documentation before the bid is submitted: the risk of rejection, discriminatory requirements and the weak points of the bid. The result is a list of corrections.
One review procedure
We run a single complaint from its preparation to the decision of the panel, or defend the win of the company against a complaint by a competitor, including at the hearing itself.
Support of the tender work
We run the participation of the company in procurement on a standing basis: checking documentation, preparing bids, complaints, defence against complaints and disputes with contracting authorities.
