Public advocacy and lawmaking
We draft bills, government resolutions and ministerial orders with a full set of accompanying documents, analyse the regulatory impact of initiatives on business and give expert opinions on draft acts. We present the position of the industry in parliamentary committees, ministries and regulators, work through business associations and run advocacy campaigns.
Drafting of bills and subordinate legislation
Preparation of the texts of bills, government resolutions and ministerial orders with a full set of accompanying documents: explanatory notes, comparative tables, regulatory impact analysis.
Good legislation is shaped with the active involvement of business.
The PROCTOR team supports legislative initiatives from the moment the idea arises to the adoption of the legal act.
We analyse international experience, current legislation and the economic consequences of the future changes, and prepare bills, comparative tables, legal opinions and expert materials.
This approach allows our clients to take part in shaping the regulatory environment of their industry.
Analysis of the regulatory impact on business
Monitoring and assessment of legislative initiatives that touch the interests of the client: forecasting the consequences, preparation of comments and proposals within public consultations.
Representation of the interests of an industry before the authorities
Conveying the consolidated position of business to the relevant parliamentary committees, ministries and regulators: participation in working groups, hearings and conciliation meetings.
Work with business associations and committees
Forming industry coalitions and working through employer organisations and business associations to strengthen the negotiating position in dialogue with the state.
Expert opinions on draft legal acts
Legal expert review of draft legal acts: compliance with the Constitution, with statutes, with the obligations of Ukraine under the Association Agreement with the EU and with EU law.
Advocacy campaigns for changes in legislation
Planning and running campaigns to change or block regulatory initiatives: strategy, messages, stakeholder map, coordination of public and non public instruments within the law.
How we run an advocacy project
From an assessment of a regulatory initiative to a rule that is adopted, amended or stopped, and the acts made under it.
01
Assessment of the initiative
We take apart the draft act and calculate what it changes in the economics of the client and of the industry. The outcome is an opinion: support the rule, amend it or stop it.
02
Strategy and stakeholder map
We identify who takes the decision, who has influence and who loses from the rule. We form the messages, the timeline and the set of public and non-public instruments.
03
Rule text and its papers
We write the bill, the resolution or the order together with the explanatory note, the comparative table and the regulatory impact analysis.
04
Carrying the position through
We present the position in parliamentary committees, ministries and regulators, work through business associations and take part in working groups and hearings.
05
Support through to the result
We carry the rule through to adoption, amendment or rejection and follow the subordinate acts that will decide how it works in practice.
Formats of advocacy work
We choose by whether one opinion on a draft act is needed or the carrying of a rule through to a result.
Expert opinion on a draft
We carry out a legal review of a draft act: compliance with the Constitution, with statutes and with the obligations under the Association Agreement with the EU. The opinion is ready for consultations.
Drafting an act with papers
We prepare the text of a bill, a resolution or an order with an explanatory note, a comparative table and a regulatory impact analysis.
Advocacy campaign
We run the full project of changing the rules: strategy, stakeholders, the text of the rule, representation before the authorities and work with business associations.
