Trademark and intellectual property registration
A full cycle of registration with the Ukrainian National Office for Intellectual Property and Innovations and under international procedures (the Madrid System, the PCT, the Hague Agreement): identity searches, filing of applications, responses to refusals, maintenance of the rights in force.
Why PROCTOR
For business today a trademark is not only a means of distinguishing goods or services but a separate intangible asset that directly affects the capitalisation of the company, its market value and its investment appeal.
The PROCTOR team treats registration of a trademark as an element of a long term brand development strategy. We analyse the risk of refusal of registration, existing rights of third parties, the prospects of international expansion of the business, the possibility of licensing the brand and a future sale of the company.
We help clients build a portfolio of intellectual property assets that provides not only legal protection of the brand but also its commercial value.
How registration runs
The path from a search on the sign to the certificate: what we do at each step and how that step ends for the client.
01
Identity search
We check the sign against the databases of the national office and the international registers. The client receives an opinion on the risk of refusal and on third party rights that may block registration.
02
Filing strategy
We settle the list of Nice classes, the countries and the procedure: a national application, the Madrid System, the PCT or the Hague Agreement. The scope of protection matches the plans for the brand.
03
Preparing and filing
We prepare the materials of the application, the description and the images, pay the fees and file the documents. The client receives the number and the date of the application, from which priority runs.
04
Handling the examination
We answer the queries and provisional refusals of the examiner, argue the distinctiveness of the sign and, where needed, narrow the list of goods and services or reach terms with the owners of earlier rights.
05
Certificate and maintenance
We obtain the protection document and put the rights on record: renewal dates, entry of changes in the register, inclusion of the object in the customs register, licences to use.
Ways we work on registration
The scope depends on how many objects and markets have to be covered and on how difficult the examination will be.
A single application
Registration of one trademark or one object in Ukraine: the search, preparation of the application, filing and support through to the decision of the examiner.
Brand portfolio
Registration of a group of signs and objects in the classes and countries needed, including under the Madrid System, with one calendar of deadlines and fees.
Running the IP portfolio
Standing administration of all the rights of the company: monitoring of applications by others and filing of oppositions, renewals, changes in the registers, licences.
