Двоє біля екрана зі схемою договірних зв’язків у переговорній

What the webinar is about

The event is organised jointly with the Federation of Employers of Ukraine (FEU), a national organisation representing the interests of more than 3,000 enterprises across Ukraine.

A FREE SERVICE FOR FEU MEMBERS

A legal assessment of the specific situation of the company as regards force majeure: an opinion on the prospects of release from liability and a plan for securing the evidence.

How to obtain the service: after the webinar leave a request through the FEU or write to [email protected] marking it "FEU" and naming the webinar. The service is provided to FEU members free of charge, in the scope set out in the programme, with an NDA signed where needed.

The webinar is for you if at least one of these is your question

  • You have missed the deadlines for delivery or for works because of shelling, blackouts, the mobilisation of employees or the collapse of logistics.

  • A counterparty invokes the war in order not to pay you, and you want to test whether that holds.

  • The force majeure clause in your contracts was copied from a template and has never been checked.

  • You have obtained, or plan to obtain, a certificate of the Chamber of Commerce and Industry and are not sure it will really protect you in court.

  • You are entering into new contracts and want the force majeure clause drafted so that it works for you.

Programme

  1. The notion of force majeure under Article 617 of the Civil Code, Article 218 of the Commercial Code and the law on the Chamber of Commerce and Industry.

  2. Why the war in itself does not release a party from liability: the position of the Supreme Court on the causal link.

  3. The certificate of the Chamber of Commerce and Industry: its real evidential weight, the procedure for obtaining it, the typical refusals.

  4. The general letter of the Chamber of Commerce and Industry of 28 February 2022 in the practice of 2025-2026: when courts accept it and when they do not

  5. Notifying the counterparty: the deadlines, the form, the consequences of silence.

  6. The limits of release: force majeure releases a party from liability, but not from performance and not from paying for what has been received.

  7. Drafting the force majeure clause for the interests of a particular party.

  8. A review of court cases where force majeure saved a party and where it did not.
